Medical Malpractice Lawsuits

Medical Malpractice Facts

Medical malpractice can be devastating. If you or someone you love has been hurt by malpractice, consider contacting an experienced attorney to discuss your situation. If you hire an attorney, Lawsuit Hotline can possibly provide you with access to the funds you need through pre-settlement financing.

In this age of HMOs and online diagnosis tools, it seems the relationship between physician and patient is less personal than it was for our grandparents. Even so, we generally trust our medical care providers, and tend not to actively look for medical malpractice. For most patients, this tendency is sound; for a small percentage of patients, medical malpractice is an accurate description of their experience. Here are five warning signs of a possible medical malpractice situation:

  • You don’t get better with treatment.
  • Your symptoms don’t match your diagnosis.
  • Your diagnosis is based purely on a lab test.
  • Your doctor attributes common complaints to an uncommon ailment.
  • Your diagnosis usually involves a test you never received.

Medicine is an inexact science, and technology changes month-to-month rather than year-to-year. But if you, a patient untrained in the practice of medicine, can use the information tools available, don’t you expect at least that much from your doctor?

Experience

Nine-year-old Rachel’s aging father had been feeling ill for several years. Malnourished as a child, Carl now dealt with some lasting effects from his younger years, such as tooth loss. Diagnosed as diabetic after one hospital blood test during a kidney infection, Carl removed his favorite foods from the house and went on a strict diabetic diet. Meanwhile, his fatigue, leg pain, and memory loss persisted.

Unwilling to embarrass his long-time physician by asking for a second opinion, Carl took everything at face value, although his wife privately shared concerns about Carl’s recent memory loss and personality changes with the doctor.

“So, your wife tells me you can’t remember anything,” Carl’s doctor laughed during a follow-up appointment. Angry and embarrassed, Carl came home, accused his wife of gossiping behind his back, and took to his bed.

After Carl collapsed in the family hallway late one night, an emergency room doctor placed a hand on Carl’s abdomen, visually located three bulging aneurysms, and rushed him by ambulance to a larger, better-equipped hospital. Unfortunately for little Rachel and her family, it was too little, too late, and Carl died shortly thereafter.

“Perhaps we couldn’t have prolonged his life,” Rachel’s mother commented bitterly, “but we could have made it a whole lot more comfortable.”

Action

Many people that are involved in medical malpractice lawsuits eventually face financial hardships. Many can’t work and the legal process is long and drawn out. Some cases take many years to resolve. Lawsuit Hotline specializes in the funding of settled and pre-settled medical malpractice lawsuits. During the funding process, Lawsuit Hotline requests some of the case documentation, underwriting evaluates the lawsuit to determine whether funding can be extended, and if approved, a contract is issued for the injured party and his/her attorney to sign. The injured party’s attorney then repays the lien when the case is resolved. All funding is non recourse, which means that if for any reason, there is no recovery on the case, then no money is owed back.
